BTD Draft and BTD Library - Terms of Use
These terms are a contract between BTD Technology Pty Ltd, ACN 670 507 276 ("BTD", "we") and the business that uses BTD Draft ("your company"). They cover the BTD Library website, the BTD Draft AutoCAD kit and the 30-day trial (together, "the Service"). They take effect when you tick the box or select I agree. If you accept for a company, you confirm you have authority to bind it.
1. What the Service is
The Service is drafting software for businesses.
- The Library keeps your company's crane data and rigging gear. It uses AI to read manufacturers' documents and suggest values for your people to check.
- The kit runs in your own AutoCAD and draws sheets from what your people enter.
- Checks are rule checks on drawings, plus AI reviews of the sheets you send.
BTD does not plan, design, engineer, approve, certify or supervise any lift. A sheet is a draft for your people to check. It is not a lift plan, and it does not say a lift is safe.
You need your own licence for AutoCAD LT 2024 or newer, or full AutoCAD. AutoCAD is a trademark of Autodesk, Inc., and BTD is not connected with Autodesk.
2. Your company's responsibilities
Your company plans, checks and approves every lift through its own competent people. Its duties under work health and safety law, including occupational health and safety law in Victoria, stay with it. So do the applicable Australian Standards, including the AS 2550 series, and the crane manufacturer's instructions.
Your company must:
- check every value read from a document before saving it
- check every output before using it, including the crane set-up, capacity, radii, heights, rigging figures, mat sizes, dimensions and every sheet
- keep its crane data and rigging list up to date, and stop using anything out of service
- upload only documents it has the right to use
The capacity on a sheet is the figure your person enters. The Service does not choose a crane set-up or confirm a figure against a load chart.
The Service does not assess the following, and your company's competent person must deal with them:
- ground bearing capacity and outrigger loads (a mat size on a sheet is only what your person entered)
- wind and weather
- obstructions, power lines and exclusion zones
- the real mass and centre of gravity of the load
- the condition, inspection and certification of the crane and rigging
- site access, operator competence, communications and the lift sequence
3. The 30-day trial
The trial costs A$300, and no GST is charged. It is paid once by card through Stripe. BTD does not keep your card details, and nothing is charged again.
The trial gives your company 30 days, one AutoCAD seat, the Grove GMK4100L-1 ready to draw, and three PDF readings. It ends by itself. After that, your company can sign in and see these terms, but the rest of the Service and the kit stop until you agree full access with BTD.
The Refund Policy explains when the trial fee is refunded.
4. Fees after the trial
Fees after the trial are set out in a written quote that shows the total price. If GST applies, the quote shows it and BTD gives a tax invoice. BTD may suspend the Service if a fee is more than 14 days overdue after a written reminder.
5. Licence and limits
While your company has access, BTD gives it a non-exclusive, non-transferable licence to use the Service for its own work, on the agreed number of AutoCAD seats.
Your company must not:
- copy, share, sell or give the kit, BTD's blocks, title blocks, software or Library data to anyone outside your company
- work around the key, seat or sign-in controls
- take the software apart, except where the law allows it
- use the Service to build a competing product
6. Who owns what
BTD owns the Service, the kit, its blocks and its title blocks. Your company owns its data and the drawings it makes. Manufacturers' documents remain the property of their owners.
Your company lets BTD store and process its data to run and support the Service. Drawings already made stay yours to use after access ends, and BTD blocks may stay in those drawings for that use.
7. Logins, keys and seats
Keep logins and your company key confidential, and tell BTD promptly if one is exposed. Each computer using the kit takes one seat, and your company can free a seat on the AutoCAD page.
BTD may suspend a login, key or seat only if it reasonably believes there is misuse or a security risk. BTD will tell your company why and restore access once the problem is fixed.
8. Your data and records
BTD uses your company's data only to run and support the Service, keep the records below, and meet the law. BTD does not sell it. The Privacy Policy explains how personal information is handled, including where it is stored.
Documents you upload and sheets you send for AI review go to BTD's AI provider, Anthropic, to be processed. AI suggestions and reviews can be wrong.
BTD keeps a record of each lift drafted and each drawing check: what was entered, what the Service answered, who did it and on which computer. This lets your company and BTD show later what the system said.
Within 30 days after access ends, BTD will give your company a copy of its data on request. BTD deletes the data within 12 months after access ends, or sooner on request, except records the law requires it to keep. Deleted data leaves encrypted backups within about 30 days.
9. Availability and changes to the Service
BTD aims to keep the Service running but does not promise it will always be available or free of errors. BTD may change features. If a change materially reduces what your company has paid for, BTD will give reasonable notice. Your company may then end access and receive a pro-rata refund of prepaid fees.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or changes a right or remedy under the Australian Consumer Law that cannot be excluded. The Service comes with guarantees under that law. The Refund Policy sets out the main remedies.
Where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, BTD limits its liability for failing a consumer guarantee, as the law allows, to:
- for services: supplying them again, or paying for them to be supplied again
- for goods: replacing or repairing them, or paying for that
This limit does not apply if your company shows that relying on it would not be fair or reasonable.
11. Liability
This clause is subject to clause 10 and applies as far as the law allows.
- Neither party is liable to the other for indirect or consequential loss, or for loss of profit or revenue.
- BTD's total liability arising from the Service is limited to the fees your company paid in the 12 months before the claim.
- BTD's liability is reduced to the extent your company caused or contributed to the loss. That includes a lift your competent person did not check and approve, and data your company entered or checked.
- Nothing limits liability that the law does not allow to be limited, including liability for fraud.
12. Indemnity
Your company indemnifies BTD against claims by other people to the extent they arise from your company's lifts or its breach of these terms. The indemnity is reduced to the extent BTD caused or contributed to the loss. BTD must tell your company promptly about a claim and take reasonable steps to limit the loss.
13. Ending access
Your company may stop using the Service at any time by telling BTD. BTD may end access if your company materially breaches these terms and does not fix the breach within 14 days of written notice. BTD may also end access on 30 days' written notice, and will refund prepaid fees for the unused period.
When access ends, the kit stops working and clause 8 applies to your data. Clauses 6, 8, 10, 11, 12 and 16 continue.
14. Changes to these terms
BTD will give at least 30 days' notice of a material change and ask you to accept the new version before you continue. If your company does not accept it, it may end access and receive a pro-rata refund of prepaid fees. A change does not apply to a trial already paid for unless you accept it.
15. Notices
BTD sends notices to the email address on your company's account. Your company can send notices to info@btdengineering.org.
16. Disputes and governing law
If there is a dispute, tell BTD in writing and both sides will try in good faith to resolve it within 14 days. This does not stop either side seeking urgent court orders, or your company using a consumer regulator.
These terms are governed by the law of Victoria, Australia. The courts of Victoria, and federal courts sitting there, have non-exclusive jurisdiction.
17. General
If part of these terms cannot be enforced, the rest still applies. BTD may transfer this contract to a business taking over the Service if your company's rights are not reduced, and will tell your company first. These terms and any written quote are the whole agreement about the Service, but this does not limit rights under clause 10.
